Developers do not have permitted development rights on dwellings that are under construction.
The Permitted Development right is reserved for the Homeowner when the property has been in occupation.
Boundary Walls are generally limited to 1m in height and other walls, more than 2m from the front boundary, are also limited to 2m in height. 1m high boundary walls surmounted by railings and or piers are common. 2m high walls set back from the boundary are less common.
Here we looked to push the boundaries in height terms; with the addition of lion extrusions on top of gate piers. – Anything over 2m in height would need planning permission…
There are a lot of contrary Planning and Planning Appeal decisions relating to the location and extent of boundary-wall permitted development rights.
This homeowner was sent on a wild goose chase with a very range Appeal decision – the very acceptable proposal shown here as a concept did not go down well with Neighbours or Planners
